I've been out of the loop - Wondering

Posted: Jun 15, 2013

Retired last year...just learned that there's a suit being brought against Transcend for unfair pay practices.  Long overdue!  What would the compensation be to the MTs if they win?  TIA!

Probably an AHDI membership ;-) - nm

Huh? - For real?

If I remember correctly, that's what was offered with the Medquist lawsuit settlement. If that's the case with Transcend, too (or are you being sarcastic?), let me just say that would be seriously lame, definitely NOT lucrative, and very disappointing. But then it is Nuance we're talking about here!

My opinion is.... - Justme

it's going to be hard for the attorneys for the MTs to prove it. The lawsuit claims that MTs weren't paid for such things as time spent in research needed to complete reports. One would have to be able to prove the amount of time they spent doing this. If we take the time to document this on every report we'd for sure never get any work done!

...too many nuances involved (forgive my unintentional pun) and no real accurate documentation. I guess it's like being a stay-at-home mom (which is why I took this job)...only YOU really know your true worth monetarily so the satisfaction of a job well done will have to substitute for the $$$, I guess! I do wish the MT plaintiffs well though...they certainly deserve any compensation they can get and then some! Oh--and thanks for taking the time to reply, you guys!

The Transcend 13 (plus) and their attorney(s) - better be ready for an ugly

knock-down fight going up against Nuance while at the same time getting any justice whatsoever AND ensuring their attorney gets paid. Read on:

"...the parties indicated that Medquist made clear throughout the negotiations period that it was unwilling to agree to a settlement in which direct payments to the class members would be made, and that no settlement could be reached if the Plaintiffs insisted on such direct payments."

That is only part of how the settlement funds went to AHDI - note the keywords ONLY PART.

Meaning - If they are smart

The last thing they should be hoping for is a payment to the class members.

The first = attorney(s) being paid and INDUSTRY-WIDE changes

The second = payment to the class members.

IF they are smart and choose to avert disappointment that is what they will seek and the order in which they will seek it.
