Wow, first taxes and now work? - onemore

I received a message today while filling out an application with Encompass stating, "Unfortunately, we are unable to offer employment to residents in your area at this time due to the high cost of doing business in your state. We apologize for any inconvenience." I live in Upstate NY. The property taxes are a killer but to be denied work because cost of living is unaffordable?

from what they were last year. The county where I live cuts anyone over 65 half on their property taxes. Last year over 2000 and this year 800. Hooray for me!

When Encompass turned you down "due to the high cost of doing business in your state," I don't think it had anything to do with your cost of living there.

I am in California, so I know a lot about this one because some companies will not hire any MTs who live in the State of California either. And the reason is NOT the cost of living.

What Encompass and the other companies who say this really mean is this: You more than likely live in a state that has a very good and very strict Labor Board. Some of these MT companies like to have their MTs work overtime and extra hours all the time, but they don't want to PAY their MTs for any of the overtime that they put in.

So, that is what their "high cost of doing business in your state" probably really means. And (just guessing here), NY probably has a very good Labor Board too, so Encompass just doesn't want to have to deal with that.

Personally, I count my blessings to be told this up front, because what it means to me is that this company is not a fair company, and not one of the companies that I would like to work for.

hours would mean no health insurance if the minimum lines were not met, which they would not be. Of course, MTSO skirts the issue of the Labor Board by forcing us to not document those hours. If we do, we face 'disciplinary measures'. (I would assume that means a warning, and then being given the crappiest dictators). I haven't found other work yet, but am looking. If I find something out of MT, I'm seriously considering blowing the whistle.

If you live in California, the Labor Board only protects you if you are an employee (doesn't apply to ICs).

But since you said you get benefits, I am assuming that you are an employee. And of course, it's completely up to you whether you want to continue working overtime hours without documenting them.

However, in the State of California, it is illegal for a company to have an employee work overtime and then not pay the employee for it.

That's why some of these companies say that the "cost of doing business in your state is too high"....because you live in a state that protects the employees and requires overtime hours to be paid. And those companies want you to WORK the overtime, they just don't want to PAY you for it.

I think it's pathetic that ANY state in the US would - not protect its workers. But, -sm

testing for a company, only to learn that they were not licensed in my state. Ya think they would look at the address on the resume before having you test.

taxes. The cost for them to register to do business in your state is probably high compared to the # of employees they would gain from your state and not worth it in their view. In order to hire you, they have to register with the state and obtain the proper licenses, etc to do business there.

It is not only overtime that comes into play but also insurance costs and rules and regs for how much the company will be responsible for dollar wise for their share of benefits. With the new rules coming into play by the Feds in February changing status from IC to business associate the landscape is again changing. Burden will be more on the back of the MT than ever before.

I have been an employee since the start of my career and never had to worry about taxes. ok here's the dirt from payroll. If you are paid a lump sum such as PTO, the IRS considers it "supplemental" and taxes it at 25%! So, if you're considering leaving, best to take all the PTO you have before. Wish I would have known that before. I have heard people on here say you have to pay your SE taxes quarterly or you get penalized. I didn't do that. I took my stuff to H&R block and they did my taxes with just a regular SE status, added to my employee status for my employee job.
