That is actually pretty common these days. When someone applies for a job, potential employers will sometimes access someone's Facebook profile and many people have not been hired based on what is out there. I work on site and my employer has a social media clause in the confidentiality agreement. Depending on what was said and the employer, they are definitely in their rights to terminate someone on the basis of what is said on social media. It might not be spying at all, just someone casually visiting a website and it might not be a "spy," managers visit message boards too.
