pay up. You will need this should you choose to go foward. Knowing she has had this "issue" prior and the trouble it brought, it may prompt her to get it together (if she is even able to). Letting her get away with it each time just makes her more comfortable doing it the next. Unfortunately, since you are an IC and basically your own business entity, the labor board is not going to help, but hopefully by turning it around on her and demanding payment officially will prompt her to stop doing what she's doing.
