Ex-Employer trying to scare me? - MTnotscared

My original post is further down on this page.  I was hired in by a company that told me I was hired contingent upon my computer passing their test.  It passed the test and I was offered employment.  Their techs downloaded their software on my computer and then for over a week, they worked on my computer, and then said my system was not compliant with their softwared.  I asked for new account with different platform, asked for them to restore my computer to its orginal state, so I could have it looked at, but would also go to a new account.  I was told to fix my computer.  this went on for awhile.  I was just emailed by the owner stating that I was never hired by his company and he is rescinding his offer of employment due to my bad behavior and unwillingness to let them help me.  How can you rescind your offer of employment once you hired somebody.  Now, I am being told I was never hired, but only in the process.  I received an offer letter.  I accepted.  They download files onto my computer for over 3 weeks and never once told me I was not hired.  Is this for real, or they are trying to scare me.  I was employed and have my letter of employment and stated on my start date, they broke my computer and I asked to be put on another account.

Cut your losses, count yourself lucky that you didn't actually work for this idiot, and find another job asap, if you haven't already.

It is not my fault I was hired in an employee and have my employee paperwork to prove it. I am moving on, but unfortunately I was an employee and my question is how can you hire someone, and then tell them they never was hired?

Hopefully, you have been employed elsewhere where you (asa well as employers( have put into the unemployment fund) taking out of paycheck)

Then tell them you will be putting in a claim to collect unemployment. Since you have the paperwork, contract, emails etc, let them prove you were not employed, not cooperative (over a week of sitting, be available etc) If not been employed within a certain time frame (check with State unempolyment office) probably out of luck on this count) Keep sending out your resumes, check the job opening a couple of times a day and send out THAT day.

You are definitely hired with the acceptance letter. I would definitely get an attorney.

If you did not meet those requirements, you are not hired. - It was contingent upon a condition.

They had a condition and you did not meet it (technologically).

Companies can rescind offers, too.

Until you have sat on their clock as an employee (having submitted your W4, etc.), you are not employed by them.

The MTSO this MT is referring to worked with her computer for 3 days, not 3 weeks. Nuance/Dictaphone technicians could not get her PC to work with the Dictaphone platform and advised her if she wanted to get it working, the only alternative was to clean load her PC. MT chose not to do this. The MTSO did not BREAK her PC, it is in good working order; only the Dictaphone software was removed. What this MT does not tell everyone is that the offer of employment was rescinded because she became irate and yelled at MTSO staff during a phone call. This type of behavior is not tolerated at eny employer.

accessed her computer, she was indeed hired. Had your company never done so, the offer to hire could have been withdrawn without recourse. At this point, regardless of her "behavior," she was hired and then fired without just cause.

She can collect unemployment, assuming she has qualified through other recent employment.

Remote employment offers are not exempt from labor laws.

For someone from a company to come and read an MT board and figure out it is their company. I would hope that a business had more things to keep them busy than to go read every comment made about their company.

What is worse is that they would share intimate details about an employee on a public forum such as this. I've seen this happen a few times and it always amazes me that someone from any given company always comes out of the woodwork to make comments about complaints people have against their company.

MTSO is a business, from my understanding. I fail to understand how a business feels the necessity to share with other employees, and a public forum, the details of other employees. Bad business if you ask me and I'd never want to work for a company who slams other people. I've seen and heard it and cut short the conversation when a supposed boss started talking about other employees. That's just wrong.

You must have some sort of connection to hear any side of the story. If you are not personally INVOLVED with the employer/employee relationship, then what you are posting is nothing more than heresay, which may not even be the correct representation.

If, however, you are directly involved in the employer/employee interaction, you're on a slippery slope disclosing this type of information on a public forum. There have been lawsuits won against employers regarding bad references given to future employers. This goes beyond that.

Being hired has nothing to do with this situation.

You did not begin work so you are not entitled to any compensation.

I think you were caught in an odd situation. I don't think you acted inappropriately nor did the employer. It just did not work out.

You gave them authorization to get into your computer to work on it the same as you would if you were having it repaired from Dell or Hewlett Packard for other issues. It does not mean you are hired nor that you are working.

If you think it is worth your money and time to pursue legally, just do it. Why in the world spend your energy here with people who can only offer you uneducated opinions?

I say lesson learned - move on.

If what the poster said is representing the truth, then she was indeed hired, and she does deserve compensation because technically speaking, when the said company was working on her computer, "she" was working. Her computer and her time was being taken from her, and she should be compensated for that. Why do we "MTs" take so much foolishness and feel that it is normal? In an outside the home work situation, nobody would expect you to sit there for 3 days, 3 weeks or 3 hours even being "held up" without pay. We have lowered our standards and our expectations. I happen to believe the MT in this case because I have had similar happen to me in my MT lifetime.

No different than sitting in their in-house office for 4 hours while they fiddle with the computer - you would expect to be paid for that

Okay, by your logic, the following scenario would mean you should not get paid either:


ABC Company calls you and offers you a position.  You accept the position.  They tell you to come to the office on Monday at 8 AM.


At 8 AM you show up in good faith, relying on their statements that you have a job and will be paid. 


They tell you to sit down at the computer while the Tech installs your info so you can have access to their files.  You sit and sit and sit and wait and wait and wait.  The Tech is having trouble with the computer.


Four hours later, the Tech throws his hands up, says “Sorry, we need to scrub the computer.  You cannot start work today.  Go home.”


You leave because you were told to BY YOUR EMPLOYER.


By your logic, because you did not “begin work” you are not entitled to compensation.  Right?  So, tell me that you would just say – “Oh, OK, keep the $60 you owe me for the four hours I sat in your office – I did not have anything better to do anyway.”


I DON’T THINK SO!!!!!  


WAKE UP PEOPLE – just because we work at home does not mean we are not Employees.  We have the same rights as the people who work in-house.  The reason we never get compensated for mandatory conference calls is because no one forces the MTSOs to pay up; for fear of getting fired.  Just because they do not pay us does not mean we do not deserve to be paid. 


The old “chalk it up to a lesson learned” is getting real old and tiring.  The only way these MTSOs will stop treating us as rugs is when we stop allowing them to walk all over us.


I applaud anyone who stands their ground and forces these MTSOs to live up to their promises.
