I think they can require just about anything as long as you're willing.

If they have a need for MTs/QA people from the hours of 11 pm to 8 am, then you have to do your work during those hours.

Per the contract, if you told them you'd work 4 hours a day and you agree to work during those second shift hours, then you do your 4 hours from 11 to 8. It's still flexible.

I think it gets very close to being illegal but not quite.
