No you are wrong. As long as they are making the MT an employee - it IS a labor violation

The only reason they get away with it is because the workers are too afraid to complain because they will be let go - no for complaining but for some other trumped up reason. But we all know it will be because they had the balls to bring up this HUGE labor violation that these companies are getting away with.
