If a job dictates a shift or shedule - then NOT IC.

Then the job is NO IC. If they try to dictate specific hours and shifts to an IC then they need to pay if there is no work available. That is why I have problems with transcription companies that hire "ic" status but try to impose a shift and yet don't pay for times when there is no work or benefits.
