are breaking their contract with the company. The company then can cancel your contract and find someone else who will work at that time. Have you never worked a business of your own? Just because you have a contract to work at a certain time of day with someone does not make you an employee. You are free to work or not, but then you have to accept the consequences. Now if that company says they don't want you at that time and don't provide work then, then the IC can choose not to work. They also would not have to check back later for work. The contract is simple. Company needs worker at a certain time and IC has said they can work at that time. No other agreement has been made. What I hate is the companies that try to tell you to check back later for work. Or threaten you if you don't get a certain amount of work done in that time. I don't believe line counts should apply to an IC. Nor should mandatory holidays or weekends unless specified in the contract. That's where most companies try to fudge with the contract. You also should be providing an invoice to the company for pay on a consistent basis. Should only have politely let them know in advance when you will be not able to work, sick or have a vacation coming up. This is so they can get someone else to cover for you and is just plain common courtesy, and should not happen too often. You should have a pride in your business and at times give more than they ask. That is a true IC. Do not have just one client also. Always have more than one client. This helps you sleep at night.
