Given the choice of severance pay and lawsuit, I'd say go for the lawsuit, since severance pay is only about $2,000(6 weeks' average pay minus tax). There's a chance that we might lose but also a chance that we might win and it would be much more than the severance pay. as you say, California is worker-friendly state. If there's a clause basically saying that future lawsuits are banned in agreement, that's tantamount to a bribe, if you ask me.
