IF you are employee status, your employer MUST pay you state minimum wage.

If they are not paying you state min wage, then probably they are not accurately recording all your hours worked.

You can quit, or work for them, clocking accurately your hours, your pay, and then turn them in to the Department of Labor.

You are employee status if they are deducting payroll taxes, medicare taxes as well as federal and state income taxes from your wages.

Otherwise, they would be sending you a check without any deductions, in which case you are a 1099 contractor, not an employee.
