The OP could simply tell the MTSO that, as an IC, she can only work the days/hours she agreed upon; then maybe on occasion, pick up some extra hours if offered (but it is her choice). She could see what happens and whether they accept this or not. If they balk at this, then she could tell them she also does IC work for another MTSO (which is perfectly legal and, in fact, encouraged), so is not available to work for them at all times. Again, see whether they accept this. If all the above fails to get them off her back, then I'd get a determination from the IRS. The surest way of losing an IC gig is to come out with the big guns right off the bat. She should just state her case in the above terms first.
