which state laws apply - IC's or Company? - confused MT

Posted: Apr 22nd, 2016 - 7:23 am In Reply to: confused on IC vs employee/employer status - confused MT

First THANK YOU to all that have replied to my post and cleared this up for me. I do truly appreciate you taking the time to clear this up for me very much.

So now knowing that I did understand the IRS classification correctly, I also understand that every state has its own laws on IC vs employee.

In this regard, which state's laws apply when the IC lives in one state and the employer/company in another? i.e. company is in California or Florida and transcriptionist is in a state somewhere between the two? If the states have different laws on the matter, does the state the IC resides in count or the one where the company you work/subcontract from count?

Again, thanks to all who take the time to respond.
