Actually all MTSOs who use ICs are at risk. If you read the laws on ICs, the IC has to set their own rate. . . Think what would happen if all ICs suddenly upped their rates a few cents per line. That'd be a happy day in this industry.
All ICs who have been misclassified need to report this to the DOL and IRS as that is a hot-button topic right now. These greedy MTSOs get by with paying no insurance benefits, no workman's compensation, no unemployment insurance, no SS, and no payroll taxes. It's fraudulent when they're treating ICs just like employees. But it won't go on forever.
